Our First Years Co

1. Agreement

By booking, purchasing, or engaging any service with Our First Years Co (“Our First Years Co”, “we”, “us”, “our”), you (“the Client”) agree to these Terms & Conditions.

Our First Years Co is the trading name of Our First Years Co Limited, operating in New Zealand.

2. Nature of Services

Our First Years Co provides educational guidance and support relating to infant and child sleep. All services are non-medical and do not diagnose, treat, or replace advice from a qualified healthcare professional.

3. Safe Sleep & Client Responsibility

• All guidance provided aligns with New Zealand safe sleep and SUDI prevention recommendations.

• Our First Years Co supports room-sharing, not bed-sharing, and promotes placing babies on their back to sleep in a safe sleep environment.

• The Client is fully responsible for their child’s sleep environment, safety, and supervision at all times.

• The Client agrees to follow safe sleep practices appropriate to their child’s age, health, and development.

4. Medical Clearance & Child Wellbeing

The Client confirms that:

• Any medical, developmental, or health conditions relating to their child have been disclosed prior to commencing services.

• Clearance from a qualified healthcare provider has been obtained where required prior.

• It is the Client’s responsibility to rule out underlying medical causes of sleep difficulties.

• Their child is gaining weight appropriately, thriving, and otherwise well before commencing a sleep plan.

Our First Years Co does not provide medical advice and accepts no responsibility for medical outcomes.

5. Client Acknowledgements

The Client acknowledges that:

• All information provided is accurate to the best of their knowledge.

• They are choosing whether or not to implement the guidance provided.

• Outcomes depend on consistency, commitment, and individual circumstances.

• Results are not guaranteed.

• Any changes made to their child’s sleep or feeding arrangements are made at the Client’s discretion.

6. Bookings, Payment & Pricing

• Full payment is required before any consultation, sleep plan, or support begins.

• No booking is confirmed until payment has been received in full and a confirmation email has been issued.

• Prices are listed in NZD and may be changed at any time and may be subject to GST where applicable.

• Services will not commence if payment is outstanding.

• Outstanding debts may be referred to a debt collection agency.

7. 1:1 Consultations & Support

Scheduling & Changes

• Consultations are scheduled by mutual agreement and subject to availability.

• Requests to reschedule must be made with at least 48 hours’ notice and are subject to availability.

• If Our First Years Co needs to reschedule due to unforeseen circumstances, the next available appointment will be offered. If unsuitable, a refund may be requested.

Cancellations & Refunds

• Cancellations with less than 48 hours’ notice may result in a partial refund or no refund.

• Once a consultation has occurred or written guidance or a sleep plan has been provided or written, no refunds will be issued, including for change of mind.

• Refunds are not provided due to dissatisfaction, lack of consistency, or failure to follow guidance.

• If support is paused after commencement, continuation is at the discretion of Our First Years Co.

Conduct & Safety

• We reserve the right to immediately terminate services without refund if a Client becomes abusive, threatening, uncooperative, or if there is concern for our safety or wellbeing.

8. Use of Support & Communication

• Follow-up support must be used within the timeframe specified at purchase.

• It is the Client’s responsibility to provide sleep logs and updates as requested.

• Communication and messaging support are subject to business hours of 8.30am-4.30pm Monday – Friday any emails or whats app messages will be replied to withing the 24 hour period.  Support is not offered over weekends or public holidays.

9. Intellectual Property & Competitor Protection

• All materials, sleep plans, resources, written content, videos, tools, communication, and methodologies remain the exclusive intellectual property of Our First Years Co.

• Clients are granted a limited, non-transferable, revocable licence for personal use only.

• Materials must not be copied, shared, adapted, resold, published, or used for professional or commercial purposes without written consent.

10. Competitor Restriction

Any individual or business operating, training, studying, or intending to operate within the infant sleep, parenting, or child consulting industry is prohibited from using Our First Years Co services or content in any manner that competes with our business. Breaches may result in liability for losses and profits gained through unauthorised use.

11. Confidentiality & Privacy

• All client information is treated with confidentiality and discretion.

• Sleep plans and resources are customised and must not be shared with third parties.

• Personal information is collected and handled in accordance with the New Zealand Privacy Act 2020 and used solely for service delivery and communication.

• Details of successful sleep training may be used for educational purposes, without sharing any personal details.

• We do not sell or trade personal information.

12. Night Nanny Services

• Services are provided at a minimum of 7 hour periods, and at the discretion of Our First Years Co. in the Auckland area only.

• Travel reimbursement may be required.

• Costing $50 for the first child and $5 per hour per additional child.

• These services are not sleep support but following the child’s current routine, if you require support to put your sleep plan into practice our In home sleep support is available.

• You agree to provide a safe environment.

13.  Post Partum In Home Support

• You agree to provide a safe environment.

• You remain responsible for your child at all times.

• Travel inclusion applies within the specified service radius. (Additional travel fees may apply outside these areas)

14. Website & External Links

Our website may contain links to third-party websites. Our First Years Co is not responsible for the content, availability, or accuracy of external sites.

15. Disclaimer & Limitation of Liability

• Our First Years Co provides educational information only and does not provide medical advice.

• Information provided is not a substitute for professional healthcare advice.

• To the fullest extent permitted by New Zealand law, Our First Years Co is not liable for any loss, injury, or adverse outcome arising from participation in services, reliance on information provided, or use of this website.

• The Client remains solely responsible for their child’s health, safety, and wellbeing at all times.

16. Governing Law

These Terms & Conditions are governed by the laws of New Zealand.

17. Changes to Terms

These Terms and Conditions may be updated at any time. The most current version will always be available on this website.

18. Acceptance

By booking or purchasing services with Our First Years Co, the Client confirms they have read, understood, and agreed to these Terms & Conditions.
